2. Eligibility to Place an Order
You must be legally capable of entering into a binding contract to place an order through our website.
Where you are under the age of legal majority in your country, an order must be placed or authorised by a parent or legal guardian.
You agree to provide accurate, complete and current information when placing an order or creating an account.
3. Agreement to These Terms
By selecting the acceptance box or clicking a button such as “Accept Terms and Conditions”, “Pay Now” or another equivalent checkout button, you are making an offer to purchase products subject to these Terms.
Your order is not accepted merely because payment has been authorised or an automated confirmation email has been sent.
A binding sales contract is formed when we confirm that the order has been accepted or dispatched, unless applicable law provides otherwise.
We reserve the right to reject or cancel an order before dispatch where:
-
A product is unavailable
-
Payment cannot be authorised
-
Fraud or misuse is suspected
-
The delivery address is incomplete or unsupported
-
A pricing or product-description error has occurred
-
The order would breach applicable laws or shipping restrictions
-
We cannot reasonably fulfil the order
Where we cancel an order after payment has been taken, we will issue an appropriate refund.
4. Account Responsibilities
You may be able to purchase products as a guest or through a customer account.
You are responsible for:
-
Keeping your login details confidential
-
Providing accurate account information
-
Preventing unauthorised use of your account
-
Informing us promptly if you suspect unauthorised access
We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
5. Products and Availability
All products are offered subject to availability.
We may:
-
Change product ranges
-
Discontinue products
-
Limit order quantities
-
Correct product information
-
Update packaging, specifications or accessories
-
Substitute packaging where the product itself remains materially the same
Where a product becomes unavailable after an order is placed, we may offer:
-
A suitable replacement
-
An alternative product
-
Store credit
-
A refund
We will not substitute a materially different product without your agreement.
6. Product Information and Images
We take reasonable care to ensure product descriptions, dimensions, compatibility information and specifications are accurate.
However, minor differences may occur due to:
-
Manufacturing revisions
-
Batch variations
-
Screen and device settings
-
Packaging updates
-
Natural materials
-
Hand finishing
-
Measurement tolerances
Product images are provided for illustration. Colours and finishes may appear differently depending on your screen settings.
Natural products, including botanicals, wood, stone and similar materials, may vary in:
-
Colour
-
Shape
-
Size
-
Texture
-
Weight
-
Surface appearance
These natural variations are not normally considered defects.
Customers are responsible for reviewing product dimensions and compatibility information before ordering.
7. Prices
Prices are shown in the currency selected or displayed on the website.
Prices may change at any time, but changes will not normally affect orders already accepted.
Prices may include or exclude taxes, duties or import charges depending on:
-
The customer’s location
-
The delivery destination
-
The shipping method
-
The information displayed at checkout
Any applicable charges known to us will be shown during checkout where reasonably possible.
8. Pricing and Listing Errors
Despite our efforts, a product may occasionally be listed with an incorrect:
-
Price
-
Description
-
Specification
-
Availability status
-
Shipping charge
-
Promotional discount
Where an obvious error occurs, we may contact you to offer the option of proceeding with the corrected information or cancelling the order.
We may cancel an order affected by a genuine and obvious error before dispatch. Any payment taken for a cancelled order will be refunded.
Nothing in this section permits misleading pricing or removes rights provided by applicable consumer law.
9. Payments
Orders must be paid in full unless another payment arrangement is expressly offered at checkout.
Available payment methods are displayed during checkout and may include:
-
Credit or debit cards
-
Digital wallets
-
PayPal
-
Other approved payment services
Payments are processed by independent payment providers.
By submitting payment information, you confirm that:
-
You are authorised to use the chosen payment method
-
The billing information is accurate
-
Sufficient funds or credit are available
-
The payment is not fraudulent or unlawful
We may delay processing while a payment or fraud review is completed.
10. Promotions and Discount Codes
Promotional offers and discount codes:
-
May be subject to separate conditions
-
Cannot be exchanged for cash
-
May have an expiry date
-
May exclude certain products
-
May be limited to one use per person or household
-
May not be combined unless expressly stated
We may withdraw or correct a promotion where it has been published in error, abused or used contrary to its stated conditions.
11. Order Processing
Orders are normally prepared for dispatch within the processing period stated on our website.
Processing may take longer during:
-
Public holidays
-
Major sales
-
Severe weather
-
Logistics disruption
-
High-demand periods
-
Warehouse closures
-
Customs or export inspections
-
Events outside our reasonable control
An order described as “processed” or “fulfilled” may already have been packed, labelled or transferred into the logistics network.
12. Shipping and Delivery
We ship internationally to supported destinations.
Delivery times vary depending on:
-
Destination
-
Product size and weight
-
Shipping method
-
Customs processing
-
Carrier capacity
-
Weather
-
Local delivery networks
-
Other circumstances beyond our reasonable control
Delivery estimates are estimates only unless a guaranteed delivery service has been expressly purchased.
Our current delivery estimates, disruption notices and sea-freight information are set out in our Shipping Policy.
13. Delivery Addresses
You are responsible for providing a complete and accurate delivery address.
Please check the following before submitting your order:
-
Recipient name
-
Building or house number
-
Street
-
Apartment or unit number
-
City
-
County, state or province
-
Postal or ZIP code
-
Country
-
Telephone number
Contact us immediately if you discover an error.
We cannot guarantee that an address can be changed after an order has entered processing or the shipping network.
Additional costs caused by an incorrect or incomplete address may be deducted from any refund where permitted by law.
14. Risk of Loss
For consumers in the European Union, European Economic Area, United Kingdom and other jurisdictions with equivalent mandatory protections, risk generally remains with Castle Dawn Aquatics until the goods are physically received by:
-
You
-
A person nominated by you
-
Another person legally treated as having accepted delivery for you
This does not include a carrier independently selected and instructed by Castle Dawn Aquatics.
Where you independently appoint a carrier that was not offered or arranged by us, risk may pass when the goods are handed to that carrier, where permitted by law.
For business customers, risk may pass when goods are handed to the carrier, unless otherwise agreed in writing.
Ownership of products does not pass until we have received payment in full, to the extent permitted by applicable law.
15. Tracking
Tracked shipping is provided where stated during checkout or in the relevant Shipping Policy.
Tracking may not update immediately after dispatch.
International shipments may pass through several logistics providers, and updates may pause while the parcel moves between networks.
A temporary absence of tracking does not necessarily mean that an order has been lost.
16. Sea Freight
Large, heavy or bulky products may be shipped by sea freight.
Sea freight normally takes approximately 35 to 45 days, although delivery may take longer due to:
-
Vessel schedules
-
Weather
-
Port congestion
-
Customs procedures
-
Container availability
-
Security checks
-
Domestic courier handover
Sea-freight shipments do not normally receive tracking updates while travelling at sea.
Tracking generally becomes available only after the shipment reaches its destination port and is collected and scanned by the domestic delivery company.
Several weeks without tracking while cargo is at sea is normal and does not, by itself, indicate loss.
17. Customs, Import Restrictions and Customer Responsibilities
You are responsible for checking whether a product may legally be imported, owned or used in your country.
This is particularly important for products involving:
-
Botanicals
-
Natural wood
-
Leaves or plant materials
-
Animal-derived materials
-
Food
-
Treatments
-
Chemicals
-
Electrical products
-
Live animals
-
Restricted aquarium products
Customs authorities may inspect, hold, reject, return or destroy goods in accordance with local law.
You are responsible for providing information reasonably requested by customs or local authorities.
Castle Dawn Aquatics is not responsible for customs action resulting from:
-
A local import restriction
-
A prohibited product
-
Failure by the customer to provide required information
-
Failure to pay applicable charges
-
Abandonment of the shipment
-
Incorrect information provided by the customer
This does not remove our responsibility to provide accurate customs documentation where that responsibility rests with us.
18. Import Duties, Taxes and Tariffs
Import duties, VAT, sales taxes, tariffs, customs charges and brokerage fees may apply.
The person responsible for these charges depends on what is stated:
-
On the product page
-
At checkout
-
In our Shipping Policy
-
In a destination-specific shipping notice
Where we expressly state that tariffs or duties are included, those identified charges are included in the amount paid.
Where charges are not stated as included, they remain the customer’s responsibility.
Customers should not refuse a parcel merely to avoid duties or import fees.
If a parcel is refused, abandoned or returned because charges were not paid, any refund may be reduced by:
-
Original shipping costs
-
Return shipping costs
-
Customs fees
-
Carrier charges
-
Storage fees
-
Other costs reasonably incurred
Any deduction will be made only where permitted by applicable law.
19. United States Shipping
Where stated in our current Shipping Policy, specified tariffs for United States orders may be included in the purchase price.
Customers remain responsible for:
-
Providing accurate importer information
-
Responding to lawful customs requests
-
Ensuring products comply with local restrictions
-
Paying any charge not expressly identified as included
United States deliveries may experience additional customs or carrier delays. Current estimated delays will be published in our Shipping Policy or relevant website notice.
20. Delayed and Lost Orders
A parcel is not automatically considered lost because it arrives after the estimated delivery date.
If tracking has not moved for the period stated in our Shipping Policy, please contact us.
We will investigate with the relevant logistics provider.
Where an order is confirmed as lost, we will provide an appropriate remedy, which may include:
-
A replacement
-
A resend
-
A refund
The available remedy will depend on applicable consumer law and the circumstances of the shipment.
21. Returns and Exchanges
We offer a 30-day return window from the date of delivery, subject to our Returns and Exchanges Policy.
Unless an exception applies, returned products must be:
-
Unused
-
Complete
-
In their original condition
-
Returned with accessories and documentation
-
Adequately packaged
You must contact us before returning an item so that we can:
-
Confirm eligibility
-
Provide return instructions
-
Provide the correct return address
Do not return goods to the address shown on the parcel without authorisation. That address may belong to a logistics provider and may not be able to accept returns.
22. European Union and EEA Right of Withdrawal
Consumers in the European Union and European Economic Area generally have the right to withdraw from an eligible online purchase within 14 days of receiving the goods, without giving a reason.
You must notify us clearly within the withdrawal period.
After notifying us, you must return the goods within the legally applicable return period.
You may inspect goods as you would reasonably inspect them in a physical shop. You may be responsible for diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods.
Unless we agree otherwise, you are responsible for the direct cost of returning goods under the Right of Withdrawal.
Where the legal Right of Withdrawal applies, refunds will be issued in accordance with our EU Refund Policy and applicable consumer law.
23. Exceptions to Cancellation and Withdrawal Rights
Cancellation or withdrawal rights may not apply to certain products, where permitted by law, including:
-
Live animals
-
Perishable products
-
Goods liable to deteriorate rapidly
-
Personalised or custom-made goods
-
Sealed goods not suitable for return for genuine health-protection or hygiene reasons once unsealed
-
Products inseparably mixed with other items after delivery
Food, treatments, additives, conditioners and botanicals are not automatically excluded merely because they belong to those product categories. Any exclusion will apply only where the legal conditions for that exclusion are met.
Faulty, damaged or incorrectly supplied products remain subject to applicable statutory rights.
24. Damaged, Faulty or Incorrect Orders
You should inspect your order promptly after delivery.
If an item arrives damaged, faulty or incorrect, contact us as soon as reasonably possible and preferably within 48 hours.
Early notification helps us investigate the issue with the warehouse, manufacturer or carrier.
Failure to contact us within 48 hours does not remove any statutory consumer rights that cannot legally be limited.
25. Video Evidence for Claims
We may request a clear, continuous video showing:
-
The product
-
The reported damage or fault
-
The packaging
-
The shipping label
-
The operation of the product where relevant
Due to the increased availability of AI-generated and digitally manipulated images, video evidence helps us verify claims and resolve genuine cases efficiently.
Where appropriate, we may ask for:
-
A short troubleshooting video
-
A video of the product connected correctly
-
A video showing serial numbers or identifying marks
-
A video showing the parcel and packaging
A claim will not be rejected solely because video evidence is impossible to provide where the customer has other sufficient evidence and mandatory consumer law requires a remedy.
We will handle claim videos in accordance with our Privacy Policy.
26. Refunds
Approved refunds will normally be returned to the original payment method.
Processing times may vary depending on:
-
Payment provider
-
Bank
-
Currency
-
Transaction type
-
Fraud or dispute checks
Shipping charges are not normally refundable for discretionary returns, except where required by law.
Where products are faulty, damaged, not as described or incorrectly supplied, your rights will be handled in accordance with applicable law and our Refund Policy.
27. Non-Returnable Products
Subject to applicable consumer law, certain products may not be accepted for discretionary return, including:
-
Live animals
-
Opened fish food
-
Opened medications and treatments
-
Opened water additives and conditioners
-
Opened botanicals where contamination or hygiene concerns apply
-
Personalised products
-
Custom-made products
This does not affect your rights where goods are faulty, damaged or not as described.
28. Cancellations
Orders may be cancelled before they enter dispatch or the shipping network.
We recommend contacting us immediately after placing the order if you wish to cancel.
Once an order has entered transit, it may no longer be operationally possible to stop the shipment.
Eligible customers may still exercise statutory cancellation or withdrawal rights after delivery.
Further information is available in our Cancellation Policy.
29. Warranties
Certain products include a commercial warranty.
Warranty periods and conditions may be stated:
-
On the product page
-
In the packaging
-
In the product manual
-
In our Warranty Policy
A commercial warranty is additional to, and does not replace, statutory rights that apply to consumers.
Warranty coverage may not apply to problems caused by:
-
Misuse
-
Incorrect installation
-
Unauthorised modification
-
Accidental damage
-
Failure to follow instructions
-
Unsuitable voltage
-
Lack of maintenance
-
Blockages or mineral deposits
-
Water ingress where the product is not designed for immersion
-
Normal wear and tear
-
Use outside the intended purpose
30. Electrical and Hardware Products
Aquarium equipment may involve electricity, water pressure, heat, moving parts or other potential hazards.
Customers must:
-
Read the instructions before use
-
Use the correct voltage and plug type
-
Install products correctly
-
Keep electrical connections protected from water
-
Use drip loops where appropriate
-
Check cables and plugs for damage
-
Disconnect electricity before maintenance
-
Follow all product safety instructions
-
Stop using a product if it appears unsafe
Installation should be performed by a suitably qualified person where required.
Nothing in these Terms excludes liability for death or personal injury caused by negligence where such liability cannot legally be excluded.
31. Aquarium Livestock and Environmental Conditions
Aquarium livestock can be affected by many factors outside our control, including:
-
Water chemistry
-
Temperature
-
Oxygen levels
-
Tank maturity
-
Disease
-
Stocking levels
-
Compatibility
-
Acclimatisation
-
Installation errors
-
Power interruptions
-
Maintenance
-
Misuse of equipment
Customers are responsible for monitoring their aquarium and maintaining suitable conditions.
Castle Dawn Aquatics is not responsible for livestock loss caused solely by unsuitable aquarium conditions, customer misuse, incorrect installation or failure to follow instructions.
This clause does not exclude liability where a defective product directly causes loss and liability cannot legally be excluded.
32. Product Safety and Recalls
You must stop using a product immediately if:
-
It appears unsafe
-
It is damaged
-
It overheats
-
It produces smoke or unusual smells
-
Its electrical cable is damaged
-
You receive a product safety or recall notice
Please contact us with your order details.
We may contact customers regarding:
-
Safety updates
-
Product recalls
-
Replacement instructions
-
Corrective measures
-
Updated operating guidance
Safety communications are service messages and may be sent even where you have opted out of marketing.
33. Proper Use of Products
Products must be used:
-
For their intended purpose
-
In accordance with instructions
-
Within stated capacity limits
-
With compatible equipment
-
In appropriate environmental conditions
You must not use products in a way that is illegal, dangerous or inconsistent with the manufacturer’s instructions.
34. Website Use
You agree not to:
-
Use the website unlawfully

Attempt to access restricted systems
-
Introduce viruses or malicious code

-
Impersonate another person
-
Submit false damage, refund or payment claims
-
Use automated purchasing tools without permission
We may restrict access, cancel orders or close accounts where there is reasonable evidence of misuse.
35. Reviews and User Content
Where you submit a review, photograph, video, comment or other content, you confirm that:
-
You created it or have permission to use it
-
It is accurate to the best of your knowledge
-
It does not infringe another person’s rights
-
It is not unlawful, threatening or defamatory
-
It does not contain malicious code

38. Third-Party Links and Services
Our website may contain links to external websites or use services provided by third parties.
We are not responsible for the content, availability, security or privacy practices of independent third parties.
Your use of third-party services may be governed by their own terms and privacy policies.
39. Limitation of Liability
To the maximum extent permitted by law, Castle Dawn Aquatics shall not be liable for indirect, incidental, or consequential damages arising from the use of our website or products. Our total liability is limited to the amount paid for the product. All implied warranties are disclaimed unless legally required.
This includes:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of mandatory consumer rights.
-
Defective products where statutory liability applies.
-
Any other liability that cannot lawfully be limited.
- Loss of livestock or damage to the aquarium.
Subject to those protections, Castle Dawn Aquatics will not be liable for losses that were not reasonably foreseeable at the time the contract was formed, which is when payment is received for the order.
For customers acting wholly or mainly for business purposes, we will not be liable for:
-
Loss of profit
-
Loss of revenue
-
Loss of business
-
Loss of opportunity
-
Loss of anticipated savings
-
Business interruption
-
Indirect or consequential loss
Any business-to-business liability limitation will apply only to the extent permitted by law.
For consumers, no financial cap in these Terms limits a remedy or compensation where applying that cap would be unfair or unlawful.

-
Your unlawful use of the website
-
Your infringement of intellectual property rights

-
Industrial disputes
-
Power failures
-
Telecommunications failures
-
Carrier insolvency
-
Supply-chain interruption
Where possible, we will take reasonable steps to reduce the effect of the disruption and keep affected customers informed.
This section does not remove any statutory right to cancel, receive goods within a legally required period or obtain a refund where applicable.

We will make reasonable efforts to investigate and respond promptly.

Delivery confirmation

Customer communications

Claim evidence

44. Governing Law
These Terms and any non-contractual obligations arising from them are governed by the laws of Hong Kong SAR, unless mandatory consumer law requires otherwise.
Where you are purchasing as a consumer, this choice of law does not deprive you of mandatory protections available under the laws of the country in which you habitually reside.
Nothing in this section prevents a consumer from bringing a claim in a court that has jurisdiction under applicable consumer-protection and private-international-law rules.
45. Business Customer Jurisdiction
Where the customer is purchasing wholly or mainly for business purposes, the courts of Hong Kong SAR will have exclusive jurisdiction, unless otherwise agreed in writing.
The exclusive-jurisdiction wording in this section does not apply where mandatory consumer law grants a consumer the right to bring proceedings elsewhere.
46. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in effect.
47. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean we have waived our right to enforce it later.
48. Assignment
You may not transfer your rights or obligations under these Terms without our written consent.
We may transfer our rights and obligations as part of a genuine sale, restructuring or transfer of the business, provided this does not reduce your statutory rights.
49. Entire Agreement
These Terms and the policies incorporated into them form the agreement between you and Castle Dawn Aquatics regarding your order.
They do not exclude any statement or representation that cannot legally be excluded.
